1.2 GIOIE PER TE SRLS operates exclusively as an intermediary and commercial broker between the client and the providers of nautical services (boat owners, charter companies, maritime operators). The Company does not own the vessels and does not directly provide navigation, on-board hospitality or catering services. Its role is limited exclusively to commercial intermediation and booking management on behalf of the client.
2.1 These Terms and Conditions govern the contractual relationship between GIOIE PER TE SRLS and the client in relation to the purchase of mini cruise packages in the Gulf of Naples and along the Amalfi Coast, with a duration of 3, 5 or 7 days, bookable through the website www.gioieperte.com.
2.2 The packages include the services described on the individual product pages at the time of purchase. Any service not expressly indicated as included shall be considered excluded and at the client's own expense.
2.3 The purchase of a package does not constitute final confirmation of the booking. Within 24 hours of purchase, the GIOIE PER TE SRLS team will contact the client to confirm the availability of the selected dates and to finalise the details of the holiday.
3.1 The client selects the desired package, departure date and number of guests on the website, and proceeds to pay the full amount of the package.
3.2 Upon completion of the purchase process, the client receives a summary email to the address provided during registration.
3.3 Within 24 working hours of purchase, GIOIE PER TE SRLS will contact the client to: — confirm the availability of the selected date — gather any particular requirements, dietary preferences or special requests — provide all operational information for departure
3.4 In the event of unavailability of the selected date, GIOIE PER TE SRLS will propose alternative dates to the client. Should the client not accept the proposed alternative dates, they will be entitled to a full refund of the amount paid within 14 working days.
4.1 Prices shown on the website are expressed in Euros and are inclusive of VAT where applicable.
4.2 Payment of the full package amount is required at the time of purchase, prior to booking confirmation.
4.3 Payments are processed through the Ecwid platform and its secure payment systems. GIOIE PER TE SRLS does not store clients' credit card or bank account data.
4.4 Package prices are fixed and not subject to variation during the navigation period, except for services expressly excluded from the packages (alcoholic beverages, cocktails, snorkelling and other optional activities indicated on the individual product pages).
4.5 GIOIE PER TE SRLS reserves the right to modify package prices at any time, it being understood that such modifications will have no effect on purchases already completed.
5.1 The client may cancel the booking according to the following terms, by sending written notice to info@gioieperte.com:
— Cancellation more than 60 days before the departure date: full refund of the amount paid, net of bank transaction fees. — Cancellation between 30 and 60 days before the departure date: refund of 50% of the amount paid. — Cancellation between 15 and 29 days before the departure date: refund of 25% of the amount paid. — Cancellation less than 15 days before the departure date: no refund.
5.2 In the event of cancellation by GIOIE PER TE SRLS due to force majeure (adverse weather conditions, safety reasons, extraordinary events), the client is entitled to a full refund of the amount paid or to rescheduling of the cruise on alternative dates, at their choice.
5.3 Refunds will be processed within 14 working days of the cancellation notice, using the same payment method used for the original purchase.
6.1 Pursuant to Italian Legislative Decree 206/2005 (Consumer Code) and EU Directive 2011/83/EU, the 14-day right of withdrawal provided for distance contracts does not apply to contracts for leisure services where the contract provides for a specific date or period of performance, as is the case with the mini cruises offered by GIOIE PER TE SRLS (art. 59, lett. n, D.Lgs. 206/2005).
6.2 The cancellation policy described in Article 5 of these Terms and Conditions therefore applies.
7.1 GIOIE PER TE SRLS operates exclusively as a commercial intermediary and broker between the client and the providers of nautical services. The Company does not own the vessels, does not directly employ the on-board crew (Captain, Skipper, Chef, Hostess) and is not the entity providing navigation, catering and on-board hospitality services.
7.2 GIOIE PER TE SRLS shall not be liable for: — accidents, physical or material damage occurring on board the vessels — non-performance or conduct of the on-board crew — changes to routes or itineraries ordered by the Captain for safety or weather reasons — damage to persons or property during shore excursions — theft, loss or damage to the client's personal belongings on board or ashore — delays, cancellations or modifications to the service due to force majeure, adverse weather conditions, or orders from maritime or port authorities
7.3 The contractual liability of GIOIE PER TE SRLS is limited to the amount of the package purchased by the client.
7.4 The client is responsible for their own conduct on board and during shore excursions. GIOIE PER TE SRLS reserves the right to exclude from the service, without refund, clients whose behaviour puts the safety of themselves, other guests or crew members at risk.
7.5 Clients are strongly advised to take out a travel insurance policy covering cancellations, accidents, medical assistance and repatriation.
8.1 The client undertakes to: — provide truthful and complete information at the time of booking — promptly communicate any food allergies, intolerances, relevant health conditions or special requirements — comply with the safety instructions given by the Captain and crew — arrive at Baia Marina at the time indicated in the confirmation notice — be in possession of valid identity documents for the entire duration of the cruise
8.2 Minors under 18 years of age may participate in mini cruises only if accompanied by a parent or legal guardian.
9.1 All content present on the website www.gioieperte.com — texts, photographs, videos, logos, illustrations, graphics and multimedia materials — is the exclusive property of GIOIE PER TE SRLS or is used under a regular licence from the rightful owners.
9.2 Without prior written authorisation from GIOIE PER TE SRLS, it is expressly prohibited to: — reproduce, copy, distribute or publish any content from the website — use photographs, videos or texts for commercial purposes — modify or rework the content of the website — use the trademark, logo or name GIOIE PER TE SRLS
9.3 Any violation of intellectual property rights will be pursued before the competent authorities.
10.1 These Terms and Conditions are governed by Italian law.
10.2 For any dispute relating to the interpretation, validity or performance of this contract, the Court of Naples shall have exclusive jurisdiction, without prejudice to the mandatory jurisdiction of the consumer's court of residence pursuant to Italian Legislative Decree 206/2005.
10.3 Clients who are consumers residing in the European Union may also have recourse to the European Commission's ODR (Online Dispute Resolution) platform, available at: https://ec.europa.eu/consumers/odr
11.1 GIOIE PER TE SRLS reserves the right to amend these Terms and Conditions at any time. Amendments will be published on the website with the date of update and will take effect from the date of publication.
11.2 Use of the website following publication of amendments constitutes acceptance of the new conditions.
